You must not live around here. We have a horrific problem with drivers not being charged for killing pedestrians while speeding, making illegal turns, all manner of illegal/careless driving. They get cited for the infraction and the person in the crosswalk is just collateral damage as long as the driver says they didn't see them.

It’s not when you consider the abysmal rate at which careless drivers here are charged with anything related to a pedestrians death. Guy in my neighborhood last year was distracted and realized he was about to hit a stopped bus at a speed which wouldn’t result in any serious injuries; instead he veered onto the sidewalk and killed a woman walking with her boyfriend to see Christmas lights. No charges.

As someone who often has almost daily close run-ins with cars not yielding in crosswalks in New York, I’m okay with this.* New York’s system for dealing with this problem is beyond fucked up and it’s very clear that drivers know how few consequences there are. I consider myself a driver first and a pedestrian second, but there’s zero excuse for the way people drive.

* Today I got clipped by an TC&L SUV that 1) wasn’t yielding to pedestrians in the crosswalk. 2) Was actually cutting off the car that was yielding. This was on 81st and CPW, which is crowded with children crossing into the Park or going to the AMNH. So I feel particularly strongly about this today.

Not paying attention would be a known a cause, therefore an “accident” caused by not paying attention isn’t an accident.

Anywhere else in the country, the sort of negligence displayed by running over a kid crossing in a crosswalk would result in criminal charges. In NYC, the police turn their heads and write it off as another “accident.” It’s negligence and should be punished. When you are operating a vehicle, whether you’re on the streets of Manhattan or Omaha, you have a duty to be alert and to be careful. Unfortunately, that standard is better upheld in Omaha.

And who are you to say it doesn’t? If it gets people to pay attention and do something about it, maybe it does. Sure it’s not entirely accurate, but they’re making a rhetorical point. If you wanted to murder somebody, you could run them down with a car, and then claim it was “just” an “accident” and you’d probably not even get a ticket.

That used to be how drunk drivers got off the hook. They didn’t “intend” to kill anybody when they started drinking and...

Eventually people wised up to that being a completely idiotic excuse. And really, not paying attention when one is sober is even more damning, but somehow a lot of people are fine with letting it slide as long as a guy hasn’t had a drink.

There is a standard for criminal recklessness. The prosecutors decided that not seeing the kid didn’t meet that standard. If you don’t agree, take it up with your elected officials.

And crashed by drunk drivers are accidents; that’s why they are not charged with murder.
